Still have to read SMs countenance despite risk of legal dispute?

This time too, JYJ couldn’t come back. On 29 Jan, JYJ’s management company C-JeS Entertainment announced, “CGV has noticed the cancellation of the screening of JYJ’s daily documentary <The Day>.” It happened only 10 days after the contract between C-JeS and CJ has been sealed. C-JeS stated, “CGV suddenly notified us about the cancellation via phone call. Even though we have suggested them several times to modify the contract and said that we would agree to other conditions, we eventually received a cancellation notice.” C-JeS has filed a complaint to the FTC and the Anti-Corruption & Civil Rights Commission. What is the reason that made CGV of CJ terminate the contract despite risk of legal dispute?

‘External pressure’ toward a certain idol movie

CJ and CGV’s official answer is that “there was a problem in the contract process, which was belatedly found out. Both sides have tried to find an agreement but failed.” Kim Taehee-ssi of CGV’s PR team said, “Before deciding the screening, CGV hasn’t seen that documentary even once. CGV’s related team didn’t also properly follow the reporting procedures.” CG also informed C-Jes about the ‘problem of contract process’, such as, “exchange of emails relating to the screening between both sides without seeing the documentary, press release without prior confirmation about the final screening scale, contract sealing without going through internal reporting procedures,” etc. Nevertheless, C-JeS stated, “On 21 Jan, CGV backed out of the contract, saying that ‘the contract wasn’t delivered through the proper channel’. We already said that they could see the documentary at anytime and suggested to postpone the opening day so that they could have internal preview, but they kept insisting on the cancellation.” If what C-JeS said is true, we should focus more on ‘CGV’s internal problems’. 

C-JeS and CGV have entered into a contract process in early January. At that time, CGV told C-JeS, “The contract must be verified by a legal team that has also verified the contents of other idols’ movie.” It seemed that they were preparing for the premiere like they have done for the screening of Big Bang or Super Juniors’ movie. However, after various media reported this theatrical release on 18 Jan, the atmosphere has changed. Lee Jae-Eun, Director of Public Relations of C-JeS said, “On 19 Jan, the person in charge of CGV told us, “After the press release, an issue was raised by CJ E&M. We’ll try to defend to get the final decision from CGV Director and proceed as originally planned.” Outwardly, it looks like a simple non-fulfillment of contract from CGV but actually, in evidence, there was external pressure preventing the screening.

CGV’s PR team denied, “CJ E&M and CGV are entirely independent companies. SM Entertainment putting pressure on CGV through CJ E&M is nonsense talk.” However, to sum up the situation, CJ E&M only knew about the screening of JYJ’s documentary after the press release, they complained to CGV, which was taken as a strong-enough sign of the cancellation. Even in the conversion between the persons in charge of 2 companies on 19 Jan, the expression of “There was a tackle from CJ E&M” was shown. After the news came out, people said, “CJ E&M is reading SM’s countenance for fear of losing all of SM’s sound sources (T/N: business).”

CJ E&M is the company responsible for business in broadcast-cinema-music of CJ Entertainment. By the third quarter of 2011, the cable channel owned by CJ E&M such as tvN and Mnet ranked #1 in market share. Even so, it’s pretty well-known that such a [successful] CJ E&M has considerably benefited from the recovery of relationship with SM Entertainment. After CJ E&M made TVXQ’s members Hero Jaejoong, Xiah Junsu, Micky Yoochun, who were in legal dispute with SM Entertainment, stand on the stage of ‘Mnet Asian Music Awards’ in 2009, SM Entertainment refused to let their affiliated artists appear at the awards, saying that the fairness in ranking and the paid voting were questionable. In 2011, regarding SM’s artists such as Super Junior, SNSD receiving awards on stage, there was a rumor that it had been thanks to the positive attitude of CJ E&M for the sake of reconciliation. The co-production of the documentary of SM’s artists by CJ Entertainment and SM seems not unrelated to this reconciliation atmosphere. The documentary called <I am: SM Town Live World Tour in Madison Square Garden>, which aimed to be released in the first half of this year, tells the real story of the performances and daily lives of about 32 SM Entertainment artists at New York’s ‘SM TOWN Live’ concert. It seems that SNSD, Super Junior as well as 2 TVXQ’s members will also appear. An official of CJ E&M who doesn’t want to reveal his or her name said, “The production cost is expected to be up to billions of won in order to mobilize the best sound and camera equipment. The profit acquired from big idol’s contents is also profit but so much has been said within the group (CJ) about this being a gift for SM Entertainment for the sake of reconciliation.”

“A thing that was already determined ”

Regarding the fact that 2 TVXQ’s members appear in a large-scale documentary and that JYJ’s daily documentary can’t be screened, JYJ reacted as though it’s ‘an already determined thing’. C-JeS stated on their behalf, “When we came out of the so-called nest SM, we knew that we wouldn’t even be able to sing. We’re happy even if we can only stand on international stage.” <The Day> has been once abruptly canceled the broadcast on QTV last year. The documentary movie that was expected to be screened this time is an additionally re-edited version.

What kind of content this documentary <The Day>, which release was rejected several times, filled with? It shows the image of young people in their 20s experiencing their first holiday and their ordinary daily life after breaking out of the idol’s life created by an Entertainment Company. At the end of the documentary, the members ask, “Are you happy now? I am so happy right now. I wake up in the morning and until night, I can do whatever I want to do. This daily life is amazing.”

    These are the very words SM does not want the general public to hear coming from JYJ. That even after all the cockblocking, the bottomline is they are better now than where they were a few years ago. If I were SM I too would prevent this from being shown…..to their artists! Otherwise, they might all bolt out when they see this LOL XD

    • What you said is true BUT what these 3 guys did is no small feat to follow. They have not only guts and determination but the confident that is their TALENT that made them a success story. No matter how tempting this sound maybe to other others bound by unfair contracts, I think SM is 100% confident that by showing how cruel they can be to anyone dare defies them means punishment and banishment from the entertainment industry. It didn’t matter that the said attempted act spectacularly failed to crush and burn the talented JYJ. Also in my own opinion, talents housed on that entertainment do not have what it takes to break out of SM and make it out there on their own anyway.

        I’m inclined to agree with you. Who else in the SM stable is as overall talented and charismatic as the members of JYJ?
        Who else could walk the razor’s edge relying only on their great talent to be ultimately more powerful than the whole SM machine? So yes, I think that the acts who stay are fearful and insecure and suspect that they can not survive relying on their own abilities.

  5. the same thing with kbs they make a positive response at first then a few days later they phone C-jes to cancel on more than one show , here again the respond positively at first give the impression they gonna do it and then phone and cancel it. its emotional bullying messing with them pull in give them hope then push and crash their hope so that JYJ give up and go back to sm. or its just punishment for going separate ways from sm.
    anyway lotte has more cinemas than cgv has, so its really good cgv cancelled, cause now JYJ can spread their documentary wider than they could have with cgv, if sm was wise it let cgv do the agreement cause then it would be narrowing the spread of the documentary JYJ made. so u see sm just kicked its own ass : D and with cgv’s help too : D
    now JYJ not only showcase thier documentary but also file a lawsuit against this type of bullying, i wish they sue kbs and cgv and other similar bullies who show agreement then cancel on unreasonable excuses. they just need to gather the evidence and word their case eloquently convincing the court. fans need to organize too and voice their disapproval along side c-jes too. demanding JYJ broadcast in music awards and music shows is the key issue fans need to demand.

      I think that the VERY LAST THING SM wants is for the people, the fans in Korea, to see what is in that movie. To see the boys SO HAPPY, so busy, so full of plans for the future and so obviously NOT as you said, pining over “the 5” and considering going back to SM (!!!) etc etc. Everything about how they look and act in COO, and I’m sure in the shorter version “The Day”, shows that these are all lies or at the very least grave errors and misconceptions. The fallout among OT5s will be significant, especially among those who still harbor fantasies that they have been miserable and have regretted their decision to leave. Perhaps at that point they will finally begin to address exactly HOW they have allowed themselves to be lead into a thinking that was so wrong for so long. More than anything else, this film is going to be a giant wake-up call and that’s JUST what SM doesn’t want.

        yes, the boys have made dvd out of the documentary. but i believe only JYJ fans who the people that bought the dvd. esp since its quite pricey. we fans know even without the dvd, that our boys are happy and that we can see it in their daily lives. but, for non fans, they wont know abt this facts. they just know n hear what they read n see from news, or tv. esp since, as far as i know, you cant easily dl the COO dvd from internet.
        by releasing the documentary in cinemas, non-fans who curious now able to see the it, since the tickets wont be as expensive to bought their boyfriends to watch the documentary in cinema (you know, like a ‘cinema date’ lol). i believe this what sme afraid of.
        many will see that without SME they are happy. many who didnt read entertainment news, maybe still have a thought that JYJ are forever doomed by leaving SM, they cant be in TV, they cant promote they music n album, they cant be in variety show, they cant even held concerts easily, they arent as popular as SM’s artists that they see everyday in TV, looking so glamorous with their costumes n special effects stage. they cant even joined the famous n fabolous n popular concerts abroad held by SME. many artists gain more money n popularity in Japan, and many people know JYJ also cant even perform freely there. yes, JYJ are in news. but since we know how SME also control entertainment news world, their news always boasting out their successfull idols, projects, abroad concerts, etc. while our boys news maybe just small percentage compared to them (you know the 30-40 seconds reports in a corner filled with other glamorous idols news).
        this documentary show that they arent miserable. they arent unpopular, they arent ‘gain less’ than when they were at SME. and i believe this what SME most afraid of :their words : “Are you happy now? I am so happy right now. I wake up in the morning and until night, I can do whatever I want to do. This daily life is amazing.” i believe SME absolutely dont want this message and their daily lives after they arent in SME be shown, and could made public change their way of thinking about our boys. and maybe, just maybe, they dont want to have other ‘han geng’ or ‘other jyj’ happened to their other artists as well.

        Actually, I watched significant portions of it on YouTube before I got my copy so as Mulder and Scully said in “The X-Files”, “The Truth Is Out There.” lol

        Beyond that, I loved your post and completely agree. Except I wouldn’t equivocate: I think this is absolutely SM’s biggest fear — that other Idols will get the message that the grass is greener on the Freedom side of the fence and a mass migration will occur. Imagine what would happen if ALL the SM Idol groups left at the same time! Wow! Now that is something to contemplate. If they all said “F*ck this, we’re out of here” at once.

        yep. like i said, sme would never ever want another ‘han geng’ and ‘jyj’ happened to their other artists. if those saw it by their own eyes (not from 30 seconds clips taken from magz pics), but saw the reality that JYJ are free, and well paid, i believe other could encourage to left as well. esp for some idols in sme that i believe by now have had it enough with SME or just being mere ‘idols’ or felt like wanna spread their wings more. i mean, how many senior idols in SME that still shine until now? i love kang ta, and he have great voice. but i see less n less of him lately. and boa. we dont even see her as often as before. they are still young n have so many potential, but we dont even see the much in music world (except for Kang Ta be a jury in a music show n Boa in a movie) and now SME are promote SNSD everywhere, using all their money n connection they have. also they are promoting EXO M n EXO K highly and seems put all their attention to their debut (16 teasers n still counting, full of video effect n action movie slow-mo), i dont even wanna know what would happened to their other idols. we almost never heard of Trax anymore lately.
        while JYJ, even in the future when they cant be ‘idol grup’ (as it seems SK still see them as that label), JYJ still gonna shine, coz they have spread n made a name for themselves in other fields. and all of that are the quality ones.

We are aware of all the BS that is happening, but to see it written officially every time things happen is more than enough. I know it will take time for us to be really happy for JYJ but i feel confident that it will come soon.

      For me, “supporting JYJ till the end” and hoping for a reunion of the 5 are incompatible thoughts. They are diametrically opposing thoughts, to my mind. I would encourage you to re-think this contradiction. Homin are wholly contractually bound to SM for years to come. JYJ will obviously never return to SM for any reason. Holding out hope for a reunion appears to mean that the new group that JYJ have risked so much to become and worked so hard to become aren’t “enough” for you.

        Whether they do or don’t – it’s immaterial. THEY CAN’T. Not unless they are prepared to walk an even harder road than JYJ has walked to get out of there. The reason for that is simple, it’s why SM wanted them to stay in the first place: THE NAME. As long as SM has even one original member, they will continue to be able exploit the name and rake in the money from uninformed/undiscerning fans, assuming that JYJ remain too soft-hearted to legally protest its use by less than all of the 5.
        So as insane as it’s been for JYJ, were all 5 to be out of there, on the loose and God Forbid, talking about a reunion, well, I really think at that point there would be NO terrible lengths to which SM would not go to silence them.

CJ E&M just based their decision on this mathematical statement : 32 idols under the biggest/most influential and maybe most corrupt entertainment company in South Korea with all its alliances in media ARE FAR MORE GREATER THAN just 3 blacklisted artists under a neophyte company. 32>3, SM>CJes, business is business, if we will have JYJ, we will lose SM and 32 idols and everybody knows how dirty SM plays its game to anybody who dares to oppose it’s direction, SM destroys.
    THE DAY shows the image of young people in their 20s experiencing their FIRST HOLIDAY and their ordinary daily life after BREAKING OUT of the IDOL’S LIFE CREATED by an Entertainment Company…………This can be seen as anti-entertainment company (SM) by some people who are benefiting from it, they may take this as a revolutionary statement especially with the closing remarks “Are you happy now? I am so happy right now. I wake up in the morning and until night, I can do whatever I want to do. This daily life is amazing.” Once again I salute to JYJ/CJes who were brave enough to make this documentary, and are never giving up to share this despite of cancellations.
    But why is JYJ’s ex-entertainment company care about this documentary, this is just from a mere 3 rebellious idols, SM has still 32 idols who may be so happy staying under its care, why care about the three? If this company is practicing what is fair and right, I think it has no reason to be concerned about no matter what will JYJ show and say .

    this can be a prove that JYJ can be so happy even though they leave their past place and endure so many pressure from many side and their choice to leave is a right choice. They still can found their own freedom and little happiness even though they worked with a small company and only can active as a singer in the International world also they can enjoy the fruits of their own labor. For CGV matter, like i said before, God close that door because God want give JYJ a best place to get their another happiness.

      Oh, no, no. This is EXACTLY the point. Really, we can’t be pussy-footing around this inescapable fact anymore, can we?? As they do more and more to hamper and hinder JYJ, SM is only digging their own grave deeper and deeper. They are only blackening their name further and making it more and more impossible to survive the P.R. fallout that shall surely overwhelm and ruin them when the time comes. NO ONE can get away with this much evil intention and overt action. NO ONE. It never stops amazing me that SM in their arrogance and ignorance actually believes they can.

        These people utterly confound me. They are obviously adopting a Partisan stance, but what, I ask you, can POSSIBLY be in it for them to do so? What do they hope to gain? How do they imagine this will be to their benefit, to continue to defend a criminal enterprise, a rogue company completely out of control and heading for utter disaster…. how do they justify this?

        If there are any lurkers who would like to float a theory or two by me, I would dearly love to be educated.

        There really is no astounding mystery here. This is a cult phenomena. Mindsets that support this nonsense from SM have been manipulated, pure and simple. The kool-aid has already been drunk.

        Rational thought gives one the foresight to measure what you see and hear. Once that feature has been tampered with, the chance of judging what is right and wrong has disappeared. Being gullible enough to buy into SM’s BS makes one unprepared for the truth. I doubt seriously if they will even be able to acknowledge what is blatantly before them.

        Three young men who endured the hellish mess known as SME – ESCAPED – with their souls intact. Despite all the attempts to derail them, the three of them are HAPPY! Freedom has a way of doing that for people. The freedom to make one’s own choices, is at the heart of what every human being lives for.

        So for those who DO NOT understand the concept of FREEDOM, or refuse to understand it, there is no hope for them. The Universe is correcting the mistakes, and that SM cannot control.

        When I go back and unearth the stories of my ancestors who were enslaved and what they endured, I have a profound respect that is hard to put into words. One day I hope to do just that. But knowing they held on until FREEDOM came, made it possible for me to be here.

        FREEDOM is a RIGHT, it is not a gift, a luxury, a passing fancy, but a right. When the guys express the happiness of being able to get up each day, make their own choices, and can go the whole day doing what they want to do, this is what it is all about.

        So, yes SM is going to have a bird knowing rational minded people are going to see and hear what is clear as the nose on your face…three ecstactic young men who are FREE to be themselves and do what they love best…CREATE. And get paid doing it. 🙂

      Well, this is a reality that we have been tip-toeing around for a while here, but the truth is, this is part and parcel of SME’s business model. The Beautiful Faces, dancing marionettes and full immersion market saturation are WAY more important than any actual singing talent. I guess that’s what their market research has told them. So really, groups like the old DBSK were a total fluke. A group of admittedly beautiful teens who could in fact sing and sing extraordinarily well. No wonder they became as popular as they did, they were actually EXCELLENT not to mention tirelessly driven to succeed.

      It gets on my nerves too that SM keeps trotting out acts that, when you hear them actually trying to sing live, you just go…”Oh, MA-AN! These guys are terrible!” Their voices are weak, they can’t carry a tune – what the hell??? Well, that’s the current state of SM idol groups. My only suggestion is, choose not to listen.

    • super junior were supposed to be “variety show kings” and the members were to be replaced as they got older. SOMEHOW THEY GOT A HUGE FANBASE I DON’T UNDERSTAND IT.
      sm doesn’t seem to have to put much effort into them, though. their fans like anything/everything they do…

    • Well, a few can sing like Ryeowook, Kyuhyun, Yesung (and Zhou Mi, if you count SJM), but you’re right about them not really being able to sing as a whole. I remember thinking when I first got to Kpop and only knew about DBSK, “Wow, Kpop is amazing! I can’t believe pop groups can sing this well.” Then, I saw a SuJu performance of Sorry, Sorry and I thought, “Oh…. nervermind .__. “

  21. They are happy. And that is what’s important.

    I seriously pitied them back when they were still under SM. DB5K was glamorous. The biggest, most sought after band in Asia. They were (are) admired, envied, and adored by many. And even to this day no one come close to them. Some SM groups (or other companies groups) might be popular and people saying they sing, dance, perform well…. pppfffftttt…. Those idols hurts my ears. periods. (No offense, but you know I’m true)

    However, whenever I saw the backstage documentary of DB5K when they were smiling with droopy eyelids and looked almost in the verge of passing out, I knew something was wrong. Whenever I saw the date of their single release that wasn’t that far from the last single, I knew something was wrong. And when I listen to their live performance where they looked too exhausted to even stood on stage, and the unusual break in Junsu’s voice (because he rarely sings out of tune), I knew SM pushed them too far.

    So, yeah… JYJ is getting bigger and musically better. SM is just some jealous hypocritical ex-girlfriend who can’t let go of their delusion. Sure they can block JYJ now. However, Big promotion, pretty faces, vigorous dancing, and UN-original concept can only take them that far. at the end of the day, music is what people come back to. Music is the one that shaped an artist. And we, as well as SM, know that JYJ equals music.

    Periods.

      What is a really good thing to look forward to is that all music critics know that this is true. It seems an almost ridiculously obvious thing, that a music group, to be taken seriously and to develop a following, must be excellent at music. But significantly, SM’s predominant business model has moved aslant from this idea to “Pretty Young Boys” being the operative key ingredient for k-pop success. So one of the many things that we can look forward to is that JYJ will become the favorites of the music critics in years to come, the icons of a new generation of excellence in music coming from SK, and I’m sure I don’t have to tell you how important an impact this will make on the public’s perception of them and their growing fame.

  23. Am I the only one interested in the footage that might be shown? From the screenshots, it looks like we’ll be seeing things that weren’t included in the DVD(like JJ wearing that hat and Junsu playing his game).
